There are several cases in the 12th Court of Appeals in Tyler from Cherokee County Texas that are brought up on appeal for not having the proper judge’s signatures.
Juan Rayon Mendoza Rojas v. The State of Texas–Appeal from 2nd District Court of Cherokee County
– where Rojas was sent to prison by Bascom Bentley III, but the case was supposed to be in Judge Dwight Phifer’s court. “The record is devoid of any evidence that the case was properly transferred or that a judge other than Judge Phifer had authority to sign the judgment. Judge Bentley s only involvement with the case was his apparently inadvertent signing of the judgment.”
Allyn Wayne Henderson v. The State of Texas
– where Henderson did not have a valid waiver signed by the presiding judge, and presented as a matter of record. “The document also set out Appellant’s confession to each element of the offenses. The attorney for the State also signed the document. The form also contained a paragraph to be signed by the presiding judge accepting and approving Appellant’s waivers of rights and pleas of guilty. The trial court, however, did not sign the document.”
The Writ of Habeas Corpus that I filed with this court was denied because I could not provide an accurate record of the courts report of the proceedings. That means that I could not provide the court reporters trial notes. I still do not have trial notes or a record of any proceedings from the trial court. I spent 177 days in solitary confinement because someone other than Craig Fletcher signed an order that had false information in it that violated my Constitutional rights, among other things.
The question remains, how can judges who do not hear cases “accidentally” sign a document on a case that they have never heard, or how can these judges even see the documents in another case not in their courtroom? The order is here Fletcher-order-6-13-13, supposedly signed on June 11, 2013 and not filed or time stamped until June 13th, 2013, thus voiding the order, if it is not signed and filed within 48 hours.
